All cases that end up in a court of law must have a persuasive argument in order to win the case. To use this chart, it sometimes helps to imagine yourself in front of the judge explaining why you decided the use of the resource falls under Fair Use. It's all about making your best guess about where your item falls on the Fair Use scale.
Four Tenets to examine in order to determine Fair Use of a copyrighted work:

What purpose will the work be used for?
Educational Purposes Entertainment
What is the nature of the work?
How much of the work do you plan to use?
Minimal Large Amount
Will your use of the work affect the copyright holder's ability to make money?
This tenet is looked at most heavily by the judge.
